ATC Alert: 'Bottomless' Drink Specials

Dear Industry Leader,
The Alcohol and Tobacco Commission has specifically requested that we bring the following issue to your attention.

Recently, the ATC has noticed that multiple restaurants are offering “bottomless” or “endless” alcoholic beverage options. This is especially prevalent with Sunday brunch specials on drinks including but not limited to mimosas and bloody marys.

As you should know, there are a number of statutory provisions within the Indiana Alcohol Code that would prevent such promotions. Among those would be IC 7.1-5-10-20(a)(2) which states that it is unlawful to furnish two or more servings upon the placing of an order for one. Additionally, IC 7.1-5-10-20(a)(3) states that it is illegal to charge a single price for the required purchased of two or more servings of an alcoholic beverage.

This email serves as a matter of education without need to resort to the filing of violations. However, the failure to discontinue such programs may result in the filing of administrative actions for violations of the above provisions by Indiana’s Alcohol and Tobacco Commission.
